Court ruling in favor of IP-Com may prevent HTC shipments in Germany

The District Court of Mannheim Germany announced its judgment regarding one of High Tech Computer's (HTC's) patent infringement cases with German company IP-Com on March 5, according to an HTC filing with the Taiwan Stock Exchange (TSE).

The court ruled that HTC products are infringing on the specified patent and subsequently granted an injunction pending IP-Com raising a one million euro (US$1.26 million) security bond. Once in effect, the injunction will prevent HTC from selling or importing its mobile devices into Germany.

IP-Com filed a patent infringement lawsuit against HTC in April 2008 indicating HTC's products infringe upon two of its patents. The alleged infringing technology is present in the baseband chipset component supplied by HTC's chipset supplier and does not involve HTC technology or intellectual property. The recent court decision will not impact HTC's core competency or current HTC customers in Germany or devices already on sale in Germany, HTC indicated.
