NCC required to review HwaCom WiMAX license application

The Petitions and Appeals Committee of Taiwan's Executive Yuan has recently revoked a previous NCC (National Communications Commission) decision that ruled system integrator HwaCom Systems was not qualified to apply for a WiMAX license in Taiwan. The appeals committee has asked the NCC to review and properly deal with the case within a period of two months.

HwaCom was among five out of 10 applicants that received a score below the 75-point bottom limit for proposals and therefore were excluded from taking part in the bidding for three WiMAX licenses designated for the southern region of Taiwan in mid-2007.

HwaCom, which received a score of 74 points, was not satisfied with its rating, and submitted petitions to the Appeals Committee of the NCC and the Petitions and Appeals Committee of the Executive Yuan.

While the NCC's appeals committee upheld the decision made by the NCC, the appeals committee of the Executive Yuan has decided that HwaCom should have been qualified to participate in the auction because its initial bids were higher that the amounts offered by some qualified applicants.

A new NCC ruling on HwaCom's case could change the future prospects of Taiwan's WiMAX industry as the NCC might be forced to issue a new license to HwaCom, according to industry speculation.
